Our cross-disciplinary team includes local lawyers with an intimate knowledge of domestic laws and procedures, and international consultants with experience working within global insurance companies in Asia and Europe. Aaron Le Marquer, a partner in Tilleke & Gibbins' dispute resolution group, advises insurers and reinsurers in complex coverage matters and has particular expertise in multijurisdictional reinsurance disputes. Aaron previously served as Assistant General Counsel for AIG Asia Pacific in Singapore. Our team for non-contentious insurance work is led by Athistha (Nop) Chitranukroh, Of Counsel in the firm’s corporate and commercial group. Prior to joining Tilleke & Gibbins, Athistha was General Counsel at AIG, where she oversaw all operations within the legal department in Thailand.

Our recent achievements include:

  • Representing international reinsurers in a USD 6 million reinsurance arbitration brought by a local Thai cedant in respect of outstanding losses from the 2011 floods.

  • Advising a multinational insurer on coverage and liability issues in relation to a SEC regulatory investigation of a listed mutual fund and subsequent allegations of liability.

  • Representing international reinsurers in respect of USD 150 million coverage litigation arising out of property damage incurred during the 2010 Bangkok civil unrest.

  • Appointed by a Japanese insurer to defend product liability claims brought in Thailand against its insured in respect of allegedly defective airbags.

  • Acted for numerous insurers and reinsurers in the defense and settlement of property damage and business interruption claims valued at over USD 700 million, arising from the 2011 Thai floods.

  • Represented international reinsurers in respect of the defense and settlement of a USD 184 million coverage dispute arising out of an offshore gas pipeline incident.

  • Advised international brokers on the establishment and licensing of operations in Thailand, Vietnam, Cambodia, and Myanmar.

  • Assisted a large insurer on its corporate restructuring and acquisition project in Thailand.

  • Advised a global broker on its group corporate restructuring in Thailand and its market entry in Myanmar.

  • Assisted an international insurer on data privacy and outsourcing regulatory requirements to set up a regional data center in Southeast Asia.

  • Advised international reinsurers on the defense and coverage of catastrophic personal injury claims against hospitality operators.

  • Provided advice to an international insurer on the localization of various commercial policy wordings in Thailand and Vietnam.

  • Represented local and international insurers on subrogated recoveries in respect of claims paid under Industrial All Risks, fidelity, and professional indemnity policies.

  • Assisting a global insurer to obtain regulatory approval of new and innovative financial lines policy wordings.

  • Advised international reinsurers on coverage issues arising out of medical malpractice claims in Thailand and Vietnam.

  • Defended a global insurance broker against allegations of professional negligence in failing to procure adequate insurance coverage for the operations of a large Thai manufacturing conglomerate.

  • Represented international insurers and P&I Clubs in a wide variety of aviation and marine cargo and hull claims.
