Srila Thongklang secures victories for top brands and originators, including a number of market leaders in the pharmaceutical industry, in complex trademark and patent litigation in Thailand. He is a leading lawyer in the growing field of life sciences patent litigation and is recognized as one of the top 250 life sciences patent litigators worldwide by IAM Life Sciences 250. The 2012 edition of WTR 1000 called Srila a “fantastic litigator who is always thoroughly prepared,” and the 2016 edition lauded him as a “brilliant tactician.” The 2014 edition of IAM Patent 1000 commended his capabilities as a “gifted advocate.”

Clients trust Srila to protect their most precious intellectual assets. He was the lead attorney for the plaintiff in GSI Group v. Almin Enterprises, which was singled out by Asia IP as the landmark case of 2008. In this case, Srila and his team not only secured a resounding victory before the Supreme Court of Thailand, they also won a rare Anton Piller order and a preliminary injunction.

Active in a number of IP and business organizations, Srila’s memberships include the Intellectual Property Association of Thailand and the Thai Chamber of Commerce and Board of Trade of Thailand. He counsels his clients and colleagues to “be diligent and aggressive” in protecting intellectual property rights.

  • Acted on behalf of our client before the IP&IT Court and obtained a very favorable settlement just prior to the rendering of judgment in what has been widely regarded as the largest and most complex patent infringement case in Thai history. In this multijurisdictional case, our team not only secured a rare Anton Piller order to seize infringing goods, which enabled us to successfully prove infringement, but also formulated extensive strategies for protecting the validity of our client’s patent.

  • Represented a top U.S. direct sales company in a civil action against a Thai company and its authorized directors for damage to our client’s reputation, based on Section 47 of the Trademark Act and Sections 5 and 421 of the Civil and Commercial Code.

  • Secured a victory for the top producer of welding electrodes in Thailand against a local infringer in a landmark passing-off case before the Supreme Court of Thailand. The client’s resounding success may be attributed to the defensive strategy of using multiple separate trademark registrations to collectively cover the entire package design.

  • Secured a victory for a major producer of poultry feed in the United States and Thailand against a Taiwanese infringer in a Supreme Court case, which included both a preliminary injunction and an Anton Piller order. The client’s success may be attributed to the defensive strategy of using multiple invention patents.

  • Secured a victory for a large maritime transporter of carriage of goods by sea against a Thai patent owner in a criminal case for patent infringement and a civil case involving patent registration cancellation before the Supreme Court of Thailand. The Supreme Court rendered a precedential judgment to withdraw the criminal case, and it cancelled the Thai company’s patent registration.

  • Represented the top U.S. direct sales company in Thailand against a Thai company that filed a criminal case and a civil case seeking damages for alleged wrongful acts and loss of reputation.

  • Represented a multinational pharmaceutical company in patent infringement litigation against a local generic company.  Managed a major pharmaceutical-related patent during a trial on patent infringement.

  • Defended a leading Thai manufacturer of wood protection materials against an allegation of trademark infringement (claims totaled USD 1 million).

  • Obtained a precedential judgment on behalf of a leading Japanese electrical appliances company. The civil case sought to reverse the Board of Patents’ refusal to restore a Thai patent that had lapsed as the result of a failure to pay an annuity fee. We successfully proved that our client, as the inventor, would not intentionally neglect or avoid payments for annuity fees and would have wished to continuously secure protection under the law for both of its Thai patents. Therefore, the IP&IT Court rendered a judgment cancelling the Board’s decision and ordering the Board to reimburse certain court fees and lawyer fees to our client. As a result of this case, the Board of Patents has become less strict in considering this type of request from patent owners.

  • Represented a top Italian fashion design company in a case before the IP&IT Court. The IP&IT Court cancelled the defendants’ 18 trademarks, awarded a substantial amount of compensation to the client, and issued a permanent injunction prohibiting the defendant from using marks similar to the client’s trademarks and trade name.

  • Protected the intellectual property rights of a famous drug company in regard to an osteoporosis drug product passed off by another pharmaceutical company. The Supreme Court ordered the cancellation of the infringing party’s mark.

  • Represented a Fortune 500 company in a civil action against the Department of Intellectual Property to appeal an adverse decision rendered by the Board of Trademarks on the client’s trademark application.

  • Represented a highly successful Chinese manufacturing enterprise in a dispute with a Malaysian manufacturing company concerning the worldwide usage of similar trademarks pertaining to vehicles. A favorable resolution was reached through negotiation.

  • Represented a top Italian fashion brand in a civil action against the Department of Intellectual Property at the IP&IT Court to appeal the Board of Trademarks’ refusal of our client’s trademark applications. The Court withdrew the Board’s decision and accepted our client’s trademarks for registration.

  • Represented a leading British retailer in a cancellation action against a Thai company at the IP&IT Court. The Court cancelled several of the defendant’s trademark registrations and issued a permanent injunction prohibiting the defendant from using marks similar to our client’s trademarks and trade name.

  • Secured a trademark litigation victory for an agrichemical company against its former distributor, who was passing off our client’s trademarks. Finding in favor of our client’s better right, the IP&IT Court ordered the cancellation and withdrawal of 16 of the former distributor’s trademarks containing logos and wording that infringed our client’s mark and further ordered that use of the infringing marks cease.

  • Acted for a sponsor of a world-famous New Zealand rugby team in a cancellation action against a local Thai company that owned a similar trademark registration locally. The IP&IT Court and Supreme Court cancelled the Thai company’s trademark registration and issued a permanent injunction prohibiting the defendant from using marks similar to our client’s trademark.

  • Represented a top Thai fashion design company in a case before the IP&IT Court in defense against claims of performance rights infringement filed by two famous Thai models. The IP&IT Court rendered its judgment in favor of the Thai models. An appeal was commenced before the Supreme Court, which rendered a precedential judgment that reversed the IP&IT Court’s judgment and withdrew the models’ complaint.

  • Represented a leading banking and financial company based in Switzerland before the IP&IT Court in a civil case which sought to reverse the Board of Trademarks’ refusal of our client’s service mark registration. The IP&IT Court rendered a judgment cancelling the Board’s decision and ordering the Board to accept our client’s mark for registration.
