Wiramrudee (Pink) Mokkhavesa, an attorney-at-law in Tilleke & Gibbins’ intellectual property (IP) group, has been interviewed by Asia IP  magazine for her views on strategies and best practices for effective trademark enforcement.

In an article titled “Creating an Effective IP Enforcement Strategy,” Pink cautioned brand owners to remain vigilant in protecting their IP assets: “The company must carefully control its manufacturing and supply chain, and implement IP protection technology and processes to safeguard its IP rights.”

Pink outlined the two main types of trademark enforcement strategies—defensive and offensive—and how such strategies are generally implemented. She discussed specific areas that can contribute to effective trademark enforcement, such as regular monitoring to collect useful information on IP threats, the simple and cost-effective method of sending cease-and-desist letters, raids and seizures, and leveraging of public relations to enhance the value of enforcement actions.

Pink also highlighted the importance of strong government relations in IP enforcement. “A company can help better contextualize the counterfeiting situation for authorities by hosting seminars about IP laws and proceedings, as well as organizing courtesy visit or meetings with officials to share information,” she said.
