With expertise in all stages of litigation and prelitigation procedure, Jidapa Srisummacheep works within Tilleke & Gibbins’ litigation teams in Thailand handling various international and domestic disputes—particularly in relation to shipping and maritime issues, construction, international trade, and insurance.
In addition to court proceedings, Jidapa supports clients in various international and domestic arbitration matters related to logistics, construction, and international trade. After the close of the arbitral process, she also assists clients in pursuing the enforcement or setting aside of the arbitral award enforcement.
Jidapa is especially experienced in handling litigation related to bankruptcy and business reorganization. She assists clients that are creditors in the whole process of applying for debt repayment applications and has been successful in pursuing debt repayment by securing official receiver’s orders for full payment of outstanding debts. She has experience dealing with the Business Reorganization Division and its official receivers, as well as business reorganization plan preparers and Thailand’s various regulatory agencies.
She has also completed the constitutional and administrative law training program organized by Tilleke & Gibbins and led by esteemed academics, former judges, and other accomplished legal practitioners in Thailand. Jidapa graduated with an LLB from Chulalongkorn University in 2019 and is a member of the Lawyers Council of Thailand.
- Successfully defended a leading German ship management company against several local shippers in litigation over a damaged cargo claim by the shippers in Thailand, resulting in a dismissed judgment in favor of our client and protecting the client from having to pay damages of more than 100 million THB.
- Secured official receiver’s orders for payment of debt to a global aircraft rental company and a leading life insurance provider.
- Successfully represented a global freight forwarding company in pursuing the enforcement of a Thai arbitral award issued by the Thai Arbitration Institute regarding a dispute arising from a default of the transportation contract.
- Assisted a multinational company specializing in thermal insulation for power plants in an arbitral case at the Thai Arbitration Institute and successfully defended the client against a leading construction company in Thailand.
- Successfully defended one of the world’s largest surveying companies against customers' and shippers' false claims in court, with the judge ultimately agreeing with our argument that the claims should be dismissed, keeping the client from having to pay over THB 50 million (approx. USD 1.4 million) in damages.
- Represented a manufacturer and contractor in an administrative case regarding public procurement of defense-related equipment.
- Secured a victory for a Danish global logistics company against a local shipper in an arbitration case over the sinking of a barge in Thailand, resulting in an award of damages for our client.
- Assisted a team in representing a global logistics company in multiple disputes arising out of a ship collision that caused damage to sensitive cargo.
- Secured a victory for a global logistics company in international arbitration proceedings at the Thai Arbitration Institute for recovery of damages arising out of the sinking of a barge.
- Participated in the defense of one of the world’s largest surveying companies against a buyer’s claim that they issued a false certificate of weight and quality for a shipment of rice.
- Acted for a client in a civil case related to breach of contract and alleged wrongful acts.
- Assisted in advising various major airlines and aircraft leasing companies on contentious aviation matters.
- Pursued enforcement of a foreign arbitral award issued by the Badan Arbitrase Nasional Indonesia (BANI Arbitration Center) regarding a dispute arising from a coal purchase agreement.
- Assisted a foreign aircraft rental business with business reorganization. Our representation included providing legal advice, preparing and submitting the debt repayment application, attending the creditors’ meeting, and attending court hearings.
- Assisted a life insurance provider with business reorganization by preparing and submitting its application seeking debt repayment.
