Biography

Orawan Kijpakamas is an associate in Tilleke & Gibbins’ intellectual property group in Bangkok, where she specializes in prelitigation strategy for enforcing intellectual property rights in Thailand. She has extensive experience dealing with oppositions, counterstatements, appeals, and cancellations in Thailand, and she has also worked on trademark appeals and oppositions submitted to the Trademark Office in Laos.

With her broad expertise and experience in intellectual property law, Orawan provides companies with practical and actionable legal opinions on intellectual property matters and legal compliance issues. Her sound advice—coupled with her involvement in complex legal research projects—helps clients secure, protect, and capitalize on their intellectual assets.

Orawan holds LLB and LLM degrees from Thammasat University and a BA from Assumption University. She is a member of the Lawyers Council of Thailand, a member of the Thai Bar, and a qualified notarial services attorney.


Experience
  • Represented clients in defending their trademarks through appeals, counterstatements, oppositions, and cancellations.
  • Successfully petitioned Thailand’s Board of Trademarks to change its opinion regarding a disclaimer requirement, prevailing in our argument that the Roman letters at the center of the dispute were sufficiently stylized; as a result, the registrar cancelled the disclaimer instruction.
  • Represented a foreign owner of an unregistered trademark in successfully securing cancellation of the registration of a similar mark in Thailand.
  • Successfully petitioned the Lao Trademark Office’s Board of Trademarks to change its opinion regarding a disclaimer requirement by demonstrating that the trademark in question did not consist of words or phrases having direct reference to the character or quality of the goods; as a result, the registrar cancelled the disclaimer instruction.
  • Successfully petitioned Thailand’s Board of Patents to change its opinion regarding a cancellation of patent registration due to the owner not paying the annual fee.
