Biography

Giang Hoang Bach is a manager of intellectual property enforcement in the Hanoi office of T&G Law Firm LLC (TGVN), a licensed law firm and IP agent that partners with Tilleke & Gibbins for local IP filings and litigation in Vietnam. In his position, Giang provides strategic counsel to clients on safeguarding their IP rights in Vietnam.

Giang’s expertise spans all areas of intellectual property, including patents, trademarks, designs, and plant variety protection. He has extensive experience working closely with key enforcement authorities, including market surveillance agencies, the police, customs, and the courts, and regularly assists clients in executing administrative raids, pursuing criminal actions, and litigating civil cases across various provinces. In addition to intellectual property matters, Giang has experience with customs law, unfair competition law, and advertising law, and assists clients with resolving Certificate of Origin (CO) issues at customs. Leveraging his strong relationships with the authorities, Giang has successfully resolved numerous cases efficiently, delivering swift and positive results for his clients.

As an expert member of the Vietnam Anti-Counterfeit and Intellectual Property Protection Association (VACIP), Giang also plays an active role in combating counterfeiting in the country. His contributions extend beyond legal practice, as he frequently serves as a lecturer and trainer for organizations and institutions such as the Vietnam Bar Association, Hanoi Bar Association, Hanoi Law University, National Economics University, and Diplomatic Academy of Vietnam.


Experience
  • Achieved a final victory for Novartis in a landmark patent infringement case against a powerful state-owned pharmaceutical company producing a diabetes drug that contained our client’s patented compound as an active ingredient.
  • Assisted with some of Vietnam’s first patent litigation cases for European and American clients in pharmaceuticals, agrochemicals, and medical devices. Successfully secured expert opinions on patent infringement and court orders to cease production of infringing products.
  • Won a domain name dispute case at the Ho Chi Minh City Court for a German auto manufacturer. The defendant was required to surrender the disputed domain names, make a public apology, and pay the client’s legal fees. This was the most severe punishment ever dealt out by a Vietnamese court to a cyber-squatter.
  • Assisted an iconic motorbike manufacturer in civil suits against Vietnamese companies at the Hanoi Court, Thai Binh Court, and Hung Yen Court in industrial design infringement cases. Drafted the statements of claims, prepared the civil dossiers, attended the trials as the client’s representative, and kept the client updated on case developments.
  • Advised prestigious luxury brands in fashion, jewelry, cosmetics, and footwear in combating counterfeit goods in Vietnam.
  • Retrieved generic top-level domains (gTLD) through WIPO arbitration in Geneva for several clients, including a U.S. auto manufacturer, a U.K. media conglomerate, an international express delivery company, and others.
  • Successfully handled various national “.vn” domain name disputes through administrative authorities and court proceedings.
  • Assisted two German auto manufacturers in trademark infringement cases that resulted in the seizure and destruction of counterfeit auto parts and molds for creating counterfeit trademarks.
  • Advised a European healthcare company on actions to deal with a case of smuggled goods, then oversaw the seizure of the goods as well as their subsequent destruction.
  • Represented clients in organizing and attending training sessions to enhance the authorities’ awareness of counterfeit goods.
  • Cooperated with police agencies to handle many criminal cases related to counterfeit goods and copyright infringement.
  • Regularly advise clients on customs recordal of trademarks for monitoring at the border, and actions against online infringement.
