Vongkhim Lay is an associate in the intellectual property team of Tilleke & Gibbins’ Phnom Penh office. Vongkhim advises and assists clients with a wide range of intellectual property issues, including IP prosecution, anticounterfeiting strategies, and enforcement actions.
As a licensed trademark agent, Vongkhim represents her clients before government bodies such as Cambodia’s Department of Intellectual Property (DIP) and other relevant authorities by responding to office actions, acting for clients in opposition and cancellation proceedings, participating in DIP mediation proceedings, and pursuing trademark enforcement actions. Through her persistent efforts, Vongkhim fights to secure and defend the valuable intellectual property of all clients, from large multinational brands active in the Cambodian market to regional and local companies looking to assert their rights.
Prior to joining Tilleke & Gibbins, Vongkhim worked for both local and international law firms, specializing in IP and commercial matters. Vongkhim is a licensed trademark agent in Cambodia, and she speaks Khmer and English.
- Advised and assisted clients on trademark-related issues, including trademark searches, trademark registration applications, affidavits of use/non-use, recordal of changes in applicant details and assignment, renewals, oppositions and cancellations, and other relevant actions.
- Advised clients on licensing and franchising regulatory and registration requirements in Cambodia, reviewed license and franchise agreements to ensure compliance with Cambodian laws and regulations, and recorded the agreements with the Department of Intellectual Property.
- Guided and represented clients in pursuing the necessary enforcement actions to obtain compliance from infringers, including investigating suspected infringers, providing strategic plans to cope with counterfeiting or unauthorized trademark use, and negotiating with infringers and relevant authorities.
- Assisted clients with application filing, responding to office actions, and making timely annuity payment for patents, industrial designs, and copyrights in order to maintain and defend IP portfolios in Cambodia.
- Provided advice to a global tobacco company on Cambodia’s tobacco regulations, and performed due diligence on potential legal issues and compliance requirements under Cambodian laws and regulations.
