Dr. Vinh Quoc Nguyen, a senior associate in Tilleke & Gibbins’ corporate and commercial group, was interviewed by Asialaw for an article on Vietnam’s new Competition Law, which is currently being drafted. The draft law is expected to come into effect in mid-2018, and will clarify certain aspects of the current Competition Law, such as its applicability to foreign entities.
The new law will likely introduce more stringent requirements for companies to notify the competition authorities of pending mergers. As Dr. Vinh reported, “Foreign companies involved in M&A and joint venture activities, both in and outside of Vietnam should beware of the new law as they may trigger the conditions for notification … it seems that the threshold for triggering notification under the draft [is] set quite low.”
