Patcharaporn Thongprapai is an associate in Tilleke & Gibbins’ intellectual property department in Bangkok, where she specializes in IP prosecution, including trademark and patent registration and copyright recordation. Patcharaporn provides strategic guidance to clients on both international and domestic trademark and patent registration processes, as well as on copyright recordation and domain name issues. Additionally, Patcharaporn is adept at handling the intellectual property enforcement process, advising on infringement matters, and representing clients in dealings with the Thai authorities.

Patcharaporn’s expertise extends to managing patent applications for both national and overseas filings and guiding clients through the complexities of the Madrid Protocol for trademark registrations. She provides tailored solutions that address clients’ specific needs and has built a reputation for her thorough understanding of the IP laws and regulations in Thailand.   • Provided legal advice to various multinational and domestic companies on trademark registration, including conducting searches, preparing documents, and managing the entire process from filing to successful registration for both inbound and outbound applications, including amendments and any necessary actions.
  • Assisted an American education company in filing a trademark application by claiming priority from their country of origin under the Paris Convention, ensuring timely submission and protecting their trademark rights in Thailand.
  • Provided legal advice to various companies on a wide range of trademark-related matters, including trademark assignments and amendments to trademark details, both before and after registration, as well as ongoing monitoring of registered trademarks for renewal purposes.
  • Advised a Thailand-based essential oil company in filing their trademark application in Saudi Arabia, including preparing the power of attorney and obtaining legalization from the Central Islamic Council of Thailand, the Thai Department of Consular Affairs, and the Saudi Royal Embassy.
  • Assisted a Korea-based phone case company in filing an application for Thai trademark cancellation due to bad faith by conducting an onsite investigation of the cited mark in the market, gathering evidence, and preparing the cancellation application.
  • Monitored trademarks online following clients’ instructions, identifying potentially similar marks for provided reports on marks that could lead to opposition filings, helping the clients protect their intellectual property rights effectively.
  • Assisted a Chinese electric device company in filing a PCT application under a tight deadline by advising them on submission of the essential documents and requesting an extension for the remaining documents.
  • Assisted a Malaysia-based bus company in preparing and filing a design application in Thailand by claiming priority under the Hague Agreement, ensuring the filing was correctly processed for the national phase in Thailand, and guiding them through the required documentation.
  • Assisted a European luxury fashion company in registering their trademark with the Thai Customs Department and submitted a hard copy of the customs recordal application to the department while also providing guidance on how to distinguish between genuine and counterfeit products, in order to prevent counterfeit goods from being imported.
  • Assisted a Thai client in preparing and filing a copyright recordation for computer software with Thailand’s Department of Intellectual Property, ensuring the application was accurately completed and processed without any issues.

Intellectual property experts from Tilleke & Gibbins were engaged by ARISE+ IPR, a regional support program funded by the European Union and implemented by the European Intellectual Property Office, to craft a series of IP enforcement guides for Southeast Asian countries, aimed at raising local awareness of the importance of IP protection. The five-year, EUR 5.5 million ARISE+ IPR program supports regional integration through IP cooperation and aims to upgrade national IP systems for creation, protection, utilization, administration, and enforcement to be in line with international best practices and standards and the strategic objectives of the ASEAN Intellectual Property Rights Action Plan 2016-2025. The guides were developed by Tilleke & Gibbins’ lawyers in cooperation with the IP offices of each participating country, and cover issues related to trademarks, industrial designs, and geographical indications.
