Biography

Ruchiya Chuenchomrat is a trademark executive in the firm’s intellectual property group. Throughout her decade of experience in trademarks, she has successfully helped multinational IP owners register trademarks, appeal adverse decisions to the Board of Trademarks, and combat detrimental marks by filing oppositions and cancellations.

Experience

  • Represented a foreign pharmaceutical company, which owns a registered trademark in Thailand, in opposing the registration of a competitor’s mark in an appeal to the Board of Trademarks. We prevented the registration of the opposing party’s mark on the grounds that it was confusingly similar to an International Nonproprietary Name (INN) issued by the World Health Organization (WHO).
  • Represented a leading abrasives manufacturing company that owns an unregistered trademark for abrasive products in opposing the registration of a similar trademark. The Registrar ruled in favor of the opposing party, whose trademark registration had lapsed. We successfully appealed the Registrar’s unfavorable rulings with the Board of Trademarks due mainly to strong evidence of our client’s better right to the mark and the opposing party’s bad faith. The opposing party filed suit with the IP&IT Court, and the case is currently pending judgment at the Supreme Court.
  • Secured the registration of a trademark, which was previously opposed on the basis of similarity and public policy, by filing a persuasive counterstatement with the Registrar.
  • Recorded a well-known mark in Thailand utilizing an affidavit drafted to conform to the requirements and expectations of the Board of Well-Known Marks.
